Hims & Hers seeks a talented Production Counsel with substantial commercial, content, and creative industry expertise to become part of our expanding, team-driven Legal department. In this position you will collaborate directly with our Creative, Marketing, and Production organizations to structure and execute a broad array of production arrangements — spanning SAG-AFTRA and performer agreements, music rights, branded partnerships, and vendor engagements. You will tackle compelling and distinctive challenges that emerge from the convergence of consumer health, direct-to-consumer brands, and commercial content production.
You Will:
Evaluate, prepare, and finalize both incoming and outgoing production and creative contracts, encompassing SAG-AFTRA agreements, talent and performer deals, crew engagements, production services arrangements, and content licensing agreements
Evaluate, prepare, and finalize music rights for advertising campaigns, including synchronization licenses, master use authorizations, publishing arrangements, and bespoke composition deals with music production houses and independent composers
Structure and execute contracts with ad agencies, production houses, directors, photographers, and post-production suppliers for commercial campaigns, including creative agency master service agreements, production house deals, influencer and brand partnership arrangements
Serve as an embedded business affairs and legal resource for Creative and Production teams — counseling on transaction architecture, SAG-AFTRA signatory requirements, broadcast clearance standards, and AI considerations including generative AI utilization, AI-generated content ownership, and vendor AI provisions
Facilitate rights acquisition and clearance processes for commercial productions, covering talent likeness and image permissions and third-party intellectual property clearances
Build and maintain scalable production workflows, deal memo templates, and contract management processes for Hims & Hers' commercial and marketing production operation, including SAG-AFTRA signatory compliance and AI vendor terms.
You Have:
Juris Doctor from an ABA-accredited law school
Current bar admission in a minimum of one U.S. jurisdiction
5+ years of legal practice at a law firm and/or in-house setting, with a minimum of 4+ years dedicated to commercial advertising production, performer contracting, or media/entertainment business affairs
Proven track record preparing and executing commercial advertising contracts, including SAG-AFTRA commercials agreements, on-camera and voice-over performer deals, music rights agreements, deal memos, production house contracts, and performer usage and exclusivity arrangements
Knowledge of SAG-AFTRA guild rules, signatory responsibilities, and low-budget/new media contract frameworks
Experience drafting and negotiating IP licensing and content clearance agreements
Exposure to AI-related legal considerations in creative or marketing settings, including generative AI usage policies, ownership of AI-generated content, and drafting AI-related terms in vendor and platform contracts
Capacity to pivot rapidly in a high-velocity, ever-changing environment with competing demands
Strong interpersonal and communication skills with a demonstrated ability to deliver practical, commercially grounded guidance to diverse stakeholders
Track record of weighing legal exposure against business goals
Collaborative mindset and constructive, can-do approach
Orientation toward pragmatic, results-driven counsel
Preferred Experience:
Experience working at an advertising agency, commercial production company, talent agency, or in-house at a consumer brand or tech company with a high-volume commercial/marketing production operation
Experience working with music publishing companies, recording labels, or in the synchronization licensing space
Experience working in a fast-paced technology company, start-up, or direct-to-consumer brand
Hands-on counsel provided in connection with AI technologies and platforms deployed in creative, marketing, or content pipelines (e.g., generative image/video/audio tools, AI-assisted post-production, synthetic media applications)
Acquaintance with healthcare privacy related laws and related healthcare regulatory frameworks is a bonus
